Oceans Eternal, LLC – Terms of Service, Waiver of Liability, Privacy Policy, and Photo/Video Release

1. Services Provided

Oceans Eternal, LLC (“Company,” “we,” “us,” or “our”) acts solely as a broker, arranging for the scattering of cremated remains at sea through independent third-party service providers. We do not own or operate vessels or directly perform scattering services.

2. Client Responsibilities

By engaging our services, you (“Client”) confirm that you are authorized to arrange for the disposition of the cremated remains and have complied with all applicable laws and regulations. You agree to provide accurate information and necessary documentation.

3. Assumption of Risk

You acknowledge that scattering ashes at sea involves inherent risks, including but not limited to weather, sea conditions, and actions of third-party providers. You voluntarily assume all such risks.

4. Waiver and Release of Liability

To the fullest extent permitted by law, you hereby release, waive, and discharge Oceans Eternal, LLC, its owners, members, employees, and agents from any and all claims, liabilities, damages, or losses arising from or related to the services provided, including but not limited to personal injury, property damage, or emotional distress, whether caused by negligence or otherwise.

5. Third-Party Providers

All scattering services are performed by independent third-party providers. Oceans Eternal, LLC is not responsible for the acts or omissions of these providers. Any issues or disputes regarding the performance of the scattering service must be addressed directly with the provider. We will, however, assist in facilitating communication if needed.

6. Weather, Safety, and Scheduling

Scattering services are subject to weather and sea conditions. If adverse conditions arise, the third-party provider reserves the right to reschedule the service for safety reasons. The provider’s decision regarding safety is final.

7. Refund and Cancellation Policy

Once a service is confirmed and scheduled, clients may not cancel or reschedule for personal reasons. The only exception is if the third-party provider determines that weather or sea conditions are unsafe. In such cases, every reasonable effort will be made to reschedule the service on a mutually agreeable date. If rescheduling is not possible, a full refund will be issued within 7–10 business days.
*No refunds are provided for cancellations initiated by the client for personal reasons.

8. No Guarantees

While we strive to arrange services as requested, we do not guarantee specific dates, times, weather conditions, or outcomes. Services may be rescheduled or canceled due to circumstances beyond our control.

9. Compliance with Laws

You agree to comply with all applicable federal, state, and local laws regarding the transportation and disposition of cremated remains.

10. Indemnification

You agree to indemnify and hold harmless Oceans Eternal, LLC and its members from any claims, damages, or expenses (including attorney’s fees) arising from your breach of these terms or violation of law.

Privacy Policy

We may collect and process the following categories of personal data:

  • Identifying Information: Full name, email address, phone number, mailing address, emergency contact information.
  • Communication Data: Messages sent via contact forms, email, or phone.
  • Transactional and Payment Information: Service history, payment method (processed via secure third-party platforms), invoices, and receipts.
  • Technical Data: IP address, browser type, device type, operating system, time zone, and website interaction data via cookies and analytics tools.

Your information may be used to:

  • Provide, schedule, and confirm ash scattering services.
  • Respond to inquiries and provide support.
  • Manage customer communication and relationships.
  • Fulfill legal and regulatory obligations.
  • Conduct analytics to improve services.
  • Send marketing communications (with your consent).

13. How We Share Your Data

We do not sell or rent your personal data. We may share it with:

  • Service Providers: Vendors handling hosting, payments, or service fulfillment.
  • Legal Authorities: As required by law, subpoena, or court order.
  • Business Transfers: In case of merger, acquisition, or asset sale.

All third parties are required to maintain confidentiality and data security.

Photo/Video Release

20. Photo/Video Release

By participating in or attending a service arranged by Oceans Eternal, LLC, you grant permission for photographs, video, or audio recordings taken during the event to be used by Oceans Eternal, LLC for documentation, marketing, or promotional purposes, unless you notify us in writing prior to the service.
If you do not wish to be photographed or recorded, please inform us in advance in writing at info@oceanseternal.com. We will make every reasonable effort to honor your request.

Dispute Resolution

21. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms of Service, the parties agree to first attempt to resolve the matter informally by contacting Oceans Eternal, LLC at info@oceanseternal.com
If the dispute cannot be resolved informally, both parties agree to submit the dispute to mediation in Bergen County, New Jersey, before pursuing any other legal remedies. If mediation is unsuccessful, the parties may pursue legal action in the courts of the State of New Jersey.
Each party will bear its own costs and attorney’s fees unless otherwise determined by the court.
